Agreement Terms

1. Project Scope/timeline
When a project is started a project scope, timeline and estimated completion date will be provided to the client for all deliverables.

TIMELINE: Tiffany Cox Design agrees to honor the agreed-upon project timeline with the expectation that the client will provide requested content materials in a timely fashion. If the client becomes unresponsive or delays in providing feedback or content this may delay the original project timeline.

PROJECT SCOPE: Every project will include a detailed invoice with the line item deliverables for the project. Any deliverables not included in the project scope at the start of a project will be treated as a new project and as such will require a deposit (See item 2 Payment Terms)

2. Payment Terms
PAYMENT OPTIONS: The client agrees to provide an on-file credit or debit card for processing payments if on a recurring monthly plan or payment installment plan. Checks will only be accepted in special circumstances and must be discussed before the start of a project or maintenance contract. Checks will not be accepted for one-time projects unless full payment is made upfront. If payment is not received more than 7 days after the agreed-upon due date a late fee of $15 will be charged each day the payment is late.

FULL PAYMENT: If you choose to pay for your project in full upfront and request a cancelation of the project, Tiffany Cox Design will only provide a 50% refund if the project has already started. If the project is considered completed, a refund will not be possible.

PAYMENT PLAN: Tiffany Cox Design offers payment plans on most 1-off designs or web services. Payment plans can be scheduled for 2-6 monthly payments agreed upon before the start of the project. Payment must be received on the agreed due date regardless of project status. After a project has started on a payment plan, a refund of ANY payment is not possible.

MONTHLY WEBSITE MAINTENANCE: Packages must be paid in full by the due date agreed upon each month. Any lapse in payment will result in the termination of services until payment is received. If payment is not received more than 7 days after the agreed-upon due date a late fee of $15 will be charged each day the payment is late. If payment is not received within 30 days the service contract will be assumed permanently terminated and all services will be canceled including website hosting and email services.

SOCIAL MEDIA & MONTHLY MARKETING SERVICES: Social media and monthly marketing services are charged on a month-to-month contract. Packages must be paid in full by the due date agreed upon each month. Any lapse in payment will result in the termination of services until payment is received. To cancel services Tiffany Cox Design must receive a 30-day written notice. The client is responsible for payment of any completed work up to the point of the cancelation notice.

UNRESPONSIVENESS: If the client is unresponsive for longer than 2 months a project start-up fee of $200 will be charged to continue the project on top of the original estimated price. If the project hasn’t been continued in 12 months the client is not entitled to the original estimated price and must pay IN FULL the current pricing rates to continue their project.

3. Cancelation of Services
You may cancel your monthly services at any time. This includes social media services, website maintenance, or digital marketing services. Cancelation of monthly services requires a 30-day written notice. You will be responsible for all applicable fees during the 30-day cancellation period until services are officially terminated.

4. Contact and Scheduling
Tiffany Cox Design is available via Phone, Email, and Text message. The preferred method of contact is email for updates and minor requests. Should an emergency arise, you may CALL or TEXT our office at any time. Standard available office hours are Monday through Friday 9:00 am. – 6:00 pm. Tiffany Cox Design agrees to respond to all contact requests within 48 business hours other than during special business hours such as Holidays, Vacations, and Emergency Situations.

5. Text Messaging
If you opt in to receiving text messages while signing up for an event you will only receive messages pertaining to the event you registered for. By texting our business phone number (520) 255-4766 you are opting into receiving customer care text messages only and will not be added to any other marketing lists.

Message frequency: we will send no more than 1 text message per day during the duration of the event.

Opt-Out: You may opt-out at any time by replying to our messages with “STOP”. Message and data rates may apply, check with your mobile carrier for more details.

We DO NOT share your mobile number or other personal details with any third parties other than our SMS service platform.

6. Liability
WEBSITE LIABILITY: After a website design is completed and is published, an offer of website maintenance and security will be provided. If the client chooses not to purchase a maintenance and security plan they assume all responsibility for the website’s upkeep and security. This includes: maintaining content updates, plugin updates, website backups, and security scans. Tiffany Cox Design is not liable and will not restore a website that becomes compromised without an additional fee if a maintenance plan is not in place.

CONTENT LIABILITY: If your industry requires special verbiage or features to be included on websites or any marketing materials this content must be provided at the start of the project. Tiffany Cox Design is not liable for any content-related legal matters and ensures all code and design W3C standards will be met with all website projects to ensure website compliance.
